Terms of Use

Please read these Terms. They include a consent to be called and texted, consent to electronic records, and an arbitration agreement with a class-action waiver that affects how disputes are resolved. You can opt out of arbitration within 30 days (see Section 12).

1. Accepting These Terms

These Terms of Use are an agreement between you and Kilgo Insurance, LLC, doing business as Kilgo Insurance and KilGO Insurance ("Kilgo Insurance," "we," "us"), covering kilgocarinsurance.com (the "Site"). By using the Site or clicking "Get My Quote," you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. You must be at least 18 to use it.

2. About Kilgo Insurance

Kilgo Insurance is a licensed independent insurance agency located at 713 N Courthouse Rd, Ste 201, North Chesterfield, VA 23236. We serve customers in Virginia, North Carolina and Maryland, and we quote coverage with the insurance companies we are appointed with. We are not an insurance company. We don't sell leads, and we don't refer your request to other agencies.

Nothing on the Site binds coverage. Coverage starts only when an insurer accepts your application and confirms coverage in writing. The policy the insurer issues controls your coverage, not anything on the Site.

3. Quotes Are Estimates

Any price, savings figure or discount mentioned on the Site or in a follow-up call is an estimate based on what you told us. Your final premium is set by the insurer after underwriting, which may include your driving, claims and credit-based insurance history where the law allows. Discounts, including multi-policy (bundle) discounts, vary by insurer and eligibility and are not guaranteed.

4. Site Content

Site content is general information, not legal, tax or financial advice. Carrier names and logos appear only to help you tell us who insures you now. Their use does not mean those companies endorse us or that we represent every carrier shown.

5. Your Submissions

You agree that the information you submit is true, is about you (or someone you're authorized to act for), and that the phone number you enter is your own or one you're authorized to consent for. Giving false information to get an insurance quote can be insurance fraud. If you give us someone else's number without permission, you're responsible for any resulting claims.

7. Electronic Records & Signatures (E-SIGN)

You agree that clicking "Get My Quote" is your electronic signature, with the same effect as a handwritten one under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and Virginia's Uniform Electronic Transactions Act. You also agree to receive these Terms, the Privacy Policy, consent records and other disclosures electronically. To read them you need a device with a current web browser; you can print or save them from this page. For a paper copy, or to withdraw consent to electronic records, contact us using the details in Section 14. There's no fee, and withdrawing doesn't affect anything you signed electronically before that.

8. Acceptable Use

Don't submit false, automated or bot-generated requests. Don't enter other people's information without their authorization. Don't scrape, overload, probe or interfere with the Site, and don't use it for any unlawful purpose. We may block any submission or user that violates these rules.

9. Intellectual Property

The Site's design, text, graphics and the Kilgo Insurance and KilGO names and logos belong to Kilgo Insurance, LLC or its licensors. Other trademarks belong to their owners. You may view and print pages for your own personal, non-commercial use.

10. Third-Party Services

The Site uses and links to third-party services, including Google Maps, insurer websites and the tools listed in our Privacy Policy. We don't control them and aren't responsible for their content or practices. Their own terms apply to your use of them.

11. Disclaimers & Limitation of Liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, KILGO INSURANCE, LLC DISCLAIMS ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE EXTENT THE LAW ALLOWS, KILGO INSURANCE, LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND ITS TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SITE IS LIMITED TO $100.

This section covers your use of the Site only. It does not limit any rights you have under an insurance policy, under insurance laws or regulations, or any duty we owe you as your licensed agent. Where a law doesn't allow a limitation, that limitation doesn't apply.

12. Dispute Resolution & Arbitration

Talk to us first. Before starting an arbitration or lawsuit, the party with the claim must send the other a written notice describing the claim and the relief wanted, and both sides must try in good faith to resolve it informally for 30 days. Send your notice to Kilgo Insurance, LLC at the address in Section 14 or by email to jason@kilgoinsurance.com. Statutes of limitations and filing deadlines are tolled (paused) while this informal process runs.

Binding arbitration. If a dispute about the Site, these Terms, or our calls and texts to you isn't resolved within 30 days, it will be settled by binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at adr.org). We will pay all AAA filing, administration and arbitrator fees that the Consumer Rules assign to the business, and we'll pay them on time. The arbitrator may award the same individual relief a court could. You may choose to hold the hearing by phone or video, or in person in Chesterfield County, Virginia.

Class and jury waiver. You and we each give up the right to a jury trial and to take part in a class, collective or representative action. Claims may be brought only individually.

Mass Arbitration. If 25 or more similar arbitration demands are filed against us by or with help from the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules apply, and the demands may be processed in batches. Filing deadlines stay tolled for any demand waiting in a later batch.

What's not covered. Either side may bring an individual claim in small claims court instead. Nothing here stops you from filing a complaint with, or sharing information with, a government agency, including the Virginia State Corporation Commission's Bureau of Insurance, the Federal Communications Commission, the Federal Trade Commission or the Virginia Attorney General. Disputes about the coverage or claims handling under an insurance policy are governed by that policy and by insurance law, not by this section.

30-day opt-out. You can opt out of this arbitration agreement by sending us written notice within 30 days of first accepting these Terms. Mail it to the address in Section 14 or email jason@kilgoinsurance.com with "Arbitration Opt-Out" in the subject line, and include your name and phone number. Opting out doesn't affect the rest of these Terms.

If a court finds the class-action waiver unenforceable for a particular claim, that claim goes to court rather than arbitration. If any other part of this section is found unenforceable, the rest still applies.

13. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Virginia and by applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. Any dispute that goes to court under Section 12 will be heard in the state or federal courts for Chesterfield County, Virginia, and you and we agree to their jurisdiction.

14. General

These Terms and the Privacy Policy are the whole agreement about the Site. If any part is found unenforceable, the rest remains in effect. Not enforcing a term is not a waiver of it. We may update these Terms by posting a new version with a new "Last Updated" date. Changes apply from then on, and we won't apply changes to Section 12 to a dispute you've already notified us about.
